Guaranty of Service from Dan Marks
When Dan Marks markets a property, he represents the Seller only and is not the agent
of the Buyer and the Buyer is treated as a customer, not a client. Dan’s fiduciary duties are to the
Seller only. Dan Marks and Aloha Coast Realty will be paid a commission by the Seller only, as
provided in the listing agreement with the Seller and will not be paid a fee
by the Buyer.
The Buyer and Seller, in advance of any
agreement, may elect to authorize Dan Marks as the dual agent of the Buyer
and Seller. It will never be
assumed that dual agency is acceptable.
Dan Marks will follow up with interested
parties and try to encourage offers.
Dan will also notify other agents of the new listing the first day on
the market. Dan Marks will
feature the property on Realtor.com, BigIslandDan.com, and
HawaiiInformation.com, with multiple photos when they are to the Seller’s
advantage.
The owner, not Dan Marks, will set the
price of the property. Dan will
suggest a fair market value that will encourage offers based on real
data. Dan will not suggest a
higher price to a client just to try to get a listing.
Dan Marks will provide weekly written
progress reports on the sale of your property upon request. Did you feel like your agent
disappeared once the listing agreement was signed in the past? Dan wants to see your property sold
fast and for the highest price.
Hanging signs for a year at a time without a sale is no way to serve a
property owner.
When Dan Marks
represents a Buyer, he is
the agent of the Buyer and owes fiduciary duties to the Buyer. Again,
the Buyer and Seller, in advance of any agreement, may elect to authorize Dan
Marks as the dual agent of the Buyer and Seller. It will never be assumed that dual agency is
acceptable. Dan Marks and Aloha coast Realty will be paid a commission by the Seller only, as
provided in the listing agreement with the Seller and will not be paid a fee
by the Buyer.
Dan Marks will diligently
search for properties that would be pleasing to the client. Dan Marks will not base the list of
properties on what needs to sell or what is listed by Aloha Coast Realty The
only criteria for the searches will be based on the Buyer’s needs and
desires.
Promises to both
Buyers and Sellers:
Dan Marks will
professionally and skillfully negotiate with Buyers and Sellers to get the
best deal for his clients. If
Dan thinks it is possible to get more money from a Buyer on his property, he
will not leave it on the table just to make an easy sale. Dan will rarely take the first
offer. If Dan feels that he can
save his Buyer any money in negotiations, he will encourage the Buyer to try
to get the lower price.
Sometimes the sale price is not the most valuable facet of an
agreement. Dan will work out
every contingency to the advantage of his client to the best of his ability.
Dan Marks will be honest with all
clients. Knowing the truth is
important and Dan will not mislead clients about situations.
Dan Marks will monitor
issues that arise during escrow.
Dan will not disappear once the property has gone in to escrow. Dan feels that it is his duty to stay
on top of your transaction.
This is my promise and guaranty to my
clients. These guidelines are
how I conduct business and part of my business ethic. I will work to live up to these
standards with every client without discrimination.
